Avoiding a Judgment Lien on House
A credit card company sued my client because he wasn’t able to keep up on his monthly payments. The credit card company got a judgment against him, and put a lien on my client’s house. Like many people, he was surprised to learn that an unsecured creditor like a credit card company can put a lien on a house under Nebraska law. This meant that whenever the property was sold, the credit card company would get its lien paid off before my client got any money from the sale. The credit card company could even force the sale of the house.
My client and I discussed his bankruptcy questions and discovered he could file Chapter 7 bankruptcy. He got all the documents to me I needed to prepare his bankruptcy, and filed right away. I filed a Motion to get the lien removed from my client’s property and the Court granted the motion. I prepared the Motion for him, and he didn’t even have to go to a hearing. Since the Court ordered the lien removed, my client won’t be paying off the credit card company and can keep any money he makes when he sells his house.
